RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-02533 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be amended to reflect award of the Distinguished Unit Citation (DUC). _________________________________________________________________ APPLICANT CONTENDS THAT: He was assigned to the 55th Strategic Reconnaissance Wing (SRW), Forbes Air Force Base (AFB), KS, from May 1964 to Aug 1965. The unit received the DUC during this period but it is not reflected on his DD Form 214. The applicant's complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 5 Jun 1963, the applicant entered active duty. His records show he was assigned to Forbes AFB, KS, from 1 Sep 1964 to 27 Aug 1965. On 2 Jun 1967, he was honorably discharged. He served 3 years, 11 months and 28 days on active duty. The Presidential Unit Citation (PUC), formerly the DUC, is awarded to units of the United States Armed Forces for outstanding performance in action against an armed enemy occurring on or after, 16 Oct 1941 for the US Navy, and on or after 7 Dec 1941 for the US Army and US Air Force units. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial. The applicant was assigned to the 55 SRW from 1 Sep 1964 to 27 Aug 1965; however, DPSID is unable to verify the unit was awarded the PUC during his period of assignment rendering him ineligible for the award. To grant the applicant relief would be contrary to the eligibility criteria established by DOD Manual 1348.33, Manual of Military Decorations and Awards. Based on a review of the applicant’s official military records, DPSID will administratively correct the applicant’s records to show award of the Air Force Outstanding Unit Award (AFOUA) The complete DPSID evaluation, with attachment, is at Exhibit C. _________________________________________________________________ APPLICANT’S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 29 Oct 2013 for review and comment within 30 days. As of this date, this office has not received a response (Exhibit D). _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice to warrant awarding the DUC. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
